Liability Release and Assumption of Risk

In consideration of the services which are to be rendered by Endless Turns, L.L.C., their employees, agents, and all other persons or entities associated with Endless Turns, L.L.C., I agree to the following stated below:

Even though Endless Turns, L.L.C. has taken the reasonable and necessary procedures to provide you with skilled and knowledgeable guides so that you can enjoy back country skiing and ski mountaineering at its finest, but you are not without risk as we are in pristine and wilderness areas. Certain risks can not be eliminated without ruining the uniqueness of this activity, but will be minimalized. The same elements that contribute to the uniqueness of this activity (back country skiing and ski touring) can also be causes of loss or damage to your equipment, accidental injury or illness, or, in the most extreme cases, indefinite trauma or even death. We are not trying to frighten you or cause concern to you, but it is important for you to know in advance what is to be expected out there in the wilderness areas which we will visit and be aware of the inherent risks associated with this sport.

The following are some of, but not all of the risks associated with this sport of back country skiing and ski touring:

The hazards of walking on uneven terrain (both via foot and/ or skis), slips and falls due to icy conditions, being struck by icefall, rockfall, skiers/ climbers, or other objects which may be dislodged or thrown from above you while in the mountains; the use of climbing ropes and the necessary equipment which go along with ski mountaineering; the forces of nature, including but not limited to avalanches, changing weather conditions, and possible lightning; the risk of falling off the mountain, a rock (or ledge) or into a crevasse; the risk of altitude sickness or possible hypothermia due to bitter cold conditions; acute mountain sickness, cerebral and pulmonary edema; potential for human error (whether by guides or other individuals on the mountain); my own personal physical condition; and the physical exertion associated with back country skiing and ski touring endeavors.

I am aware the back country skiing and ski touring activities entail possible risks of injury and/ or death to myself and I understand that the description of these risks is not complete and that other unknown or unanticipated risks may result in injury or death as well. I agree that I will assume all responsibilities for myself, for bodily harm (injury, death, and loss of personal property and expenses thereof as a result of inherent risks and dangers and of my negligence in participating in back country skiing and ski touring activities (this includes resort based back country skiing access as well). My participation in this sport is completely voluntarily, no one is forcing me to participate, and I choose to participate in spite of the known risks.

I have read all of the above, understand, and accept the terms and conditions stated herein and acknowledge that this agreement shall be effective and binding upon myself, my heirs, assigns, personal representative, estate, and for all members of my family. I acknowledge that I am not relying on any oral, written, or visual representations or statements made by Endless Turns, L.L.C. including those made in its brochures, business cards, website or other promotional material, to induce me to participate in back country skiing and ski touring.
